Many times having your case dismissed and expunged (i.e. permanently removed) from your criminal record is a real possibility and there may be many avenues for producing this result.
Many people charge with underage drinking can go through deferred prosecution, an agreement with the state to have charges dismissed. This agreement might include: avoiding further criminal citations for some period of time, community service, an alcohol assessment and treatment, or other requirements depending on the circumstances of your charge and the particular county you are charged in. Some of the relevant circumstances of your underage drinking charge that a District Attorney would consider in setting the terms of a dismissal agreement include:
- Your prior record
- Your age
- Whether you were charged with a larger group of people (ex. house party)
- Your state of residence
- Whether driving was involved
