Almost every North Carolina personal injury attorney is paid on a contingency fee basis. This means that the attorney is paid only if he or she is able to win your case and obtain a settlement. Almost every personal injury attorney is paid 33% of whatever settlement they can recover. Keep in mind that your personal injury attorney should NOT charge you for handling your property damage claim in an auto accident case, or for helping you obtain “medpay” from your auto insurance company.
Bring with you any documentation about your accident, and your injury.
Your personal injury attorney will want to review your case with as much information as possible. Bring with you any documentation from the accident including photographs, accident reports, police investigation notes, citations, and witness statements. Also bring with you any information about your injury including doctor’s notes, emergency room notes, photographs, X-Ray results and MRI results. Finally, bring with you any information on your own automobile and health insurance.
Be prepared to sign documents.
Your personal injury attorney will want you to sign a contract with his or her law firm. This contract will allow your attorney to represent you and negotiate with the person responsible for your injuries. You will also be expected to sign a HIPPA release form so that your attorney can request and review your medical records and medical bills. You may also be asked to sign a limited power of attorney so that your attorney can sign documents for you in your absence.
Have a list of questions that you want answered.
Your personal injury attorney should be able to answer all of your questions. Be prepared to ask about how your medical treatment will be paid for, how long the process will take before settlement, how much insurance money is available, and any other questions you may have. Often times your personal injury attorney will be busy handling your and other people’s cases and it may be more difficult to get him or her to answer your questions after your initial consultation.
