Since the first text message was sent, the use and popularity of texting has skyrocketed throughout the country, especially in North Carolina. Due to this increased use of text messages, the danger of being distracted by a text while driving has exponentially increased. As such, it important to be aware of the dangers associated with texting and driving in North Carolina.

Dangers of Texting and Driving

Many studies have shown that texting and driving adversely affects an individual’s ability to alertly drive. Some have even suggested that texting and driving has the equivalent effect of driving while impaired. Regardless of whether these claims are true, it has been established that the use of a cellphone to text creates an unnecessary distraction that reduces a driver’s reaction time and awareness of surroundings. Additionally, factoring in the rampant use of texting among teenage drivers, texting and driving is an immediate danger to driving in North Carolina. As such, it is important to not text and drive, no only for your own safety, but also for the safety of all other drivers on the road.

North Carolina’s Laws on Texting and Driving

Under N.C. Gen. Stat § 20-137.4A, the use of a cell phone while driving is punishable by law. The penalty for this offense is a $100 fine and the applicable court costs. Passed by the North Carolina General Assembly in 2009, this law was enacted in order to provide deterrence for the rampant abuse of texting and driving. Although this law is in effect, it can be hard for police officers to enforce it due to the difficulties of spotting a driver that is texting. However, many police forces throughout North Carolina have begun putting an emphasis on issuing these citations in order to raise awareness.

Liability for Accidents Caused by Texting and Driving

If you have been involved in an accident, there is a distinct possibility that it could have been caused by texting and driving. If the other driver was in fact texting and driving, you have a clear indication of negligence and liability on their part. As such, it is important to investigate all possibilities when involved in a car accident.
