Greenville, SC DUI Charge

South Carolina, like all other states, has what is known as “Administrative License Suspensions” or ALS, for individuals who have been charged with DUI. These suspensions are administrative, and not criminal, thus they do not depend on whether you are ultimately convicted of the DUI. 

Whether or not you are subject to an ALS depends on the specific circumstances surrounding your arrest. For example, in South Carolina, you receive an ALS if you are arrested for DUI and refuse to submit to a chemical test of breath, blood or urine. You will also receive an ALS if you are arrested and blow a .15 or higher on the breath test. South Carolina is one of the few states where you will NOT receive an initial ALS by blowing over .08. 

The length of your suspension will depend on whether you refuse to blow or if you blow at or above .15. The number of prior convictions within the last 10 years will also affect the length of your suspension. For example, with no prior convictions, a refusal to provide a breath sample will result in a six (6) month ALS. A breath sample of .15 or higher will result in a one (1) month ALS. 

You are entitled to file an appeal of your ALS. There is a filing fee that you must pay and this appeal must be made within thirty (30) days of your arrest. The issues for this appeal are simply 1) Whether there was probable cause to arrest you, (Not proof beyond a reasonable doubt); 2) Whether you were given a written copy of and verbally informed of your implied consent rights; 3) Whether you refused to submit to a test; or 4) Whether you provided a breath sample and a) the test was .15 or hi

Will I Go to Jail if I am Convicted of a DUI in Greenville?

uWhile jail time is a possibility for any person convicted of a DUI, the realistic likelihood of jail time depends on a whole number of different factors. The vast majority of people charged with their first DUI are not sentenced to do any active jail time. Jail time is more likely for a person with prior DUI’s, a child in the car, an accident which causes injury to another person or driving on a license which is suspended for a DUI.

Will I be Allowed to Drive after Getting a DUI?

There are many driving consequences that can arise from a DUI. The length of suspensions related to DUI and the requirements for license reinstatement vary greatly depending on a number of factors, including: prior DUI charges, the blood/breath alcohol concentration (BAC) at the time of the DUI charge, and whether the driver’s license was suspended at the time of the charge. For a first offense DUI case in South Carolina, a person’s license will be suspended for one year. Most people convicted of their first offense will be able to get a limited driving privilege that will allow them to drive for work, educational, treatment, and religious purposes.

How Much Money Will Getting a DUI Cost Me?

The financial consequences of a DUI are significant and can include: attorney’s fees, court costs and fines, increases in auto insurance premiums, the cost of obtaining an alcohol assessment and completing any recommended treatment, continuous alcohol monitoring, inpatient treatment, and impact on employment.

Should I have been read my Miranda Rights during my DUI Arrest?

In South Carolina, officers frequently do not read Miranda rights at the time of a DUI arrest and often a suspect is never advised of Miranda rights during the entire encounter with police. In the context of a DUI arrest, the lack of Miranda warnings is not likely to result in a dismissal of charges. Most of the time statements made by a DUI suspect after arrest are not particularly important in the State’s prosecution. The suspect’s statements and field sobriety tests prior to arrest combined with a blood or breath alcohol result may be enough for the State to proceed to trial on a DUI charge.
